Kuro Medical, LLC. SMS PRIVACY POLICY AND TERMS AND CONDITIONS

PART I — PRIVACY POLICY

Section 1. Scope and Applicability

This Privacy Policy ("Policy") governs the collection, use, retention, and protection of personal information obtained by Kuro Medical, LLC. ("Company,") in connection with the operation of our SMS-based messaging service ("Service"). By providing your personal information and/or opting in to receive SMS communications, you acknowledge that you have read, understood, and agreed to the terms set forth in this Policy. 

Section 2. Collection of Personal Information

The Company collects only such personal information as is voluntarily submitted by the user ("User," “you,” “your”) for the express purposes of facilitating the Service. The collection of personal information is strictly limited to that which is reasonably necessary to fulfill the following functions: 

•       (a) Order Confirmation: Personal information provided in connection with the placement, processing, or confirmation of a purchase order or service request.

•       (b) Shipping and Delivery: Personal information provided for the purpose of coordinating, tracking, or communicating the status of shipment or delivery of goods or services.

•       (c) Customer Service: Personal information provided in connection with inquiries, complaints, support requests, or other communications directed to the Company's customer service function. 

The Company does not engage in the speculative, incidental, or unsolicited collection of personal information beyond the scope enumerated above. 

Section 3. Use of Personal Information

Personal information collected by the Company shall be used solely and exclusively for the purpose of completing the specific service or transaction requested by the User through the SMS platform. The Company shall not use such information for secondary purposes, including but not limited to profiling, behavioral analysis, cross-selling, or unsolicited marketing.

Section 4. Non-Disclosure of Personal Information

The Company shall not sell, lease, license, transfer, disclose, or otherwise make available any personal information to any third party, external organization, affiliate, subsidiary, or partner entity under any circumstances. All personal information collected pursuant to this Policy shall remain strictly confidential and shall be accessible only to authorized personnel within the Company whose duties require access to such information for the limited purposes described herein.

Section 5. SMS Consent and Non-Transfer of Consent Data

Any consent provided by the User to receive SMS communications from the Company, including mobile opt-in, — whether such consent is express, implied, or otherwise obtained — shall not be shared, sold, transferred, assigned, or disclosed to any third parties or affiliates for any purpose whatsoever, including but not limited to marketing, solicitation, or lead generation. Your personal data will never be shared with any other companies. The Company treats SMS opt-in consent as confidential information subject to the same protections afforded to all personal information under this Policy. SMS mobile opt-in and consent information will not be shared with any other company or third-party for marketing purposes or any other purpose.

PART II — SMS TERMS AND CONDITIONS

Section 6. Acceptance of Terms

By opting in to receive SMS messages from the Company, the User expressly agrees to be bound by these Terms and Conditions ("Terms") as well as the Privacy Policy set forth in Part I above. These Terms constitute a legally binding agreement between the User and the Company with respect to the User’s use of the SMS Service. If you do not agree to these Terms, you should not opt in to or use the Service.

Section 7. Opt-In Requirement and Enrollment

Participation in the Company's SMS-based messaging Service is predicated upon the User's completion and submission of a valid enrollment form ("Opt-In Form") prior to the initiation of any such communications. No User shall be enrolled in the Service nor receive SMS messages therefrom in the absence of an affirmative opt-in. The following conditions govern the enrollment process: 

•       (a) Mandatory Enrollment: The completion of the Opt-In Form is a mandatory prerequisite for receiving SMS communications. The Company shall refrain from transmitting messages to any mobile number for which an enrollment process has not been completed.

•       (b) Accuracy of Information: Upon submission of the Opt-In Form, the User warrants that all provided data is accurate and current, and that the User is the authorized holder of, or has obtained express permission to use, the mobile number provided.

•       (c) Voluntary Consent: Submission of the Opt-In Form represents the User's express, voluntary, and informed consent to receive communications for the purposes outlined herein. Such consent is not required as a condition of purchasing any goods or services.

•       (d) Right to Withdraw: Any consent obtained via the Opt-In Form may be revoked by the User at any time pursuant to the opt-out procedures detailed in Section 10 of these Terms. 

Section 8. Messaging Frequency

Messaging frequency may vary. The number of SMS messages you receive will depend upon the nature and status of your interactions with the Company, including but not limited to pending orders, active shipments, or open customer service matters. The Company does not guarantee a fixed number of messages per time period. 

Section 9. Message and Data Rates

Message and data rates may apply. Standard carrier messaging and data rates, as determined by your mobile carrier and service plan, may be assessed in connection with your receipt of SMS messages from the Company. The Company is not responsible for any charges imposed by your wireless service provider. You are solely responsible for any such charges.

Section 10. Opt-Out Procedure

To opt out at any time, text STOP. Upon receipt of a STOP message, the Company shall cease transmission of SMS communications to your mobile number in a commercially reasonable timeframe, subject to any messages already in transit at the time of your opt-out request. Opting out of SMS communications does not affect any other rights or obligations between you and the Company. 

Section 11. Assistance and Support

For assistance, text HELP or visit our website at https://kuromedical.com/contact. The Company will make reasonable efforts to respond to support requests in a timely manner. Use of the HELP keyword shall not constitute a waiver of any right or remedy available to either party under these Terms. 

Section 12. Governing Documents

Visit https://kuromedical.com/sms-privacy-terms-of-service to review the Company's full Privacy Policy and Terms of Service. In the event of any conflict between this document and other governing documents of the Company, the most recently updated version shall control unless otherwise stated.

Section 13. Amendments

The Company reserves the right to modify, amend, or update this Policy and these Terms at any time without prior notice. Continued use of the SMS Service following any such modification shall constitute your acceptance of the revised terms. It is your responsibility to review the current version of this Policy periodically.
